The Client agrees to pay the Photographer a non-refundable payment totalling 50% of the package at the time of the booking.The Photographer agrees not to advertise availability of this time to any other potential client.  If the Client cancels this photography shoot for any reason, the initial payment will not be returned to the Client.The balance of the payment for any photography service must be paid in full no later than the date of the session: 

Work Product:

The Photographer will make available online proofs of photos to the Client no more than thirty days (30 days) after the date of the shoot.  The Client understands and agrees that all proofs are the exclusive property of the Photographer and the Client has no right to these photos except for a license to review them, but not to store the proofs. The Photographer reserves the right to edit and will be the final authority on the images that will be offered for sale to the client. Unedited images are not representative of the final product, nor the Photographer’s work, and will not be available for sale. All photos available to the Client online are licensed for the Client’s personal use only. The Photographer will make photo proofs available in an online gallery in a reasonable amount of time after the Client has made a final order.

All photos available to the Client online are licensed for the Client’s personal use only. The Client only holds the right to print images, or to use the images for social media purposes. The images downloaded are of highest resolution. Often social media outlets compress files, and as a result this often affects the quality of the images. 

Once the Client has made their selection of the digital images that are included in their package, a second link will be provided to the Client for downloading purposes. The Client will have the option to purchase prints through your photographer or to purchase extra digital images at $15 per image. 

Note: The Photographer cannot be held responsible for the quality of images printed at a location other than through the photographer. 

4. Indemnification:

1.      The Photographer and Client agree that the Photographer is under no obligation to capture any specific moment, pose or person(s) during the shoot.  
2.      If the Photographer is unable to perform the services in this contract due to any cause outside their control, the Client agrees to indemnify the Photographer for any loss, damage or liability; however, the Photographer will return in full all payments made by the Client to the Photographer in relation to the shoot. 
3.      The Client agrees to indemnify and hold harmless the Photographer for any liability, damage, or loss related to technological failure, including data loss.  
4.      The Client understands and agrees that the Photographer is not required to maintain copies of the photos from this shoot 60 (sixty) days after the photos have been delivered to    the Client.
5.      The Client agrees to hold the Photographer harmless for any personal injury which may occur as the Client poses or works with the Photographer.
6.      The Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the Client.

5. Duty of Client

The Client will obtain all permissions necessary for the Photographer to photograph at the shoot.  The Photographer has no duty to obtain permission of reception centers, churches, buildings, properties, or other locations to operate thereon.  The Client understands and agrees that any failure to obtain these permissions resulting in fines to Photographer, or which prevent the Photographer from photographing the event(s) is not the fault, liability, or responsibility of the Photographer.

6.   Exclusive Photographer

The Client agrees and understands that no party other than the Photographer may take pictures of any poses, lighting situations, or setups made by the Photographer. This slows down the Photographer’s work and violates the Photographer’s right to take pictures of the event.  The Client agrees to take responsibility for insisting that no person(s) get in the way of the Photographer, or take pictures in these situations.

8. Assignability and Parties of Interest:

The Client agrees and understands that, unless otherwise specified in this Contract, The Client is not contracting for a personal service that will be performed by any specific Photographer.  The Photographer may sub-contract or assign this contract to any second-shooter, The Photographer may assign any Photographers associated with the Photography Company to perform its duties under this contract.  All Photographers must be capable and competent to perform the services in a workmanlike manner.

9. Release and waiver of liability:

I, having agreed to act as a model, hereby assume all the risks of participating and/or volunteering in this activity or event, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems, which preclude my participation in this activity or event. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of my application and permitting me to participate in this event, I hereby act for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: 

1)      I waive, release, and discharge from any and all liability, including but not limited to, liability arising from the ordinary negligence of the provider or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, the following entities or persons: Take A Little Paws Photography and/or their owners, directors, officers, employees, volunteers, representatives, insurance carrier, and agents, the activity or event holders, activity or event sponsors, activity or event volunteers;

2)      I indemnify, hold harmless, and promise not to sue the entities or persons mentioned in the above paragraph from all liabilities or claims made because of participation in this activity or event, whether caused by the negligence of such entities or persons or otherwise. 

1.      I acknowledge that Take A Little Paws Photography are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of Take A Little Paws Photography. 
2.      I acknowledge that this activity or event may involve physical activity, and may carry with it the potential for serious injury, or property loss. I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity or event. I understand that at this event or related activities, I may be photographed. I acknowledge that flash photography may be used during this event or activity. I agree to allow my photo, video, or film likeness to be used for legitimate purpose by the event holders, producers, sponsors, organizers, and assigns. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. 

COVID-19 Liability Release Waiver for Clients Due to the 2019-2020 outbreak of the novel Coronavirus (COVID-19), our business is taking extra precautions with the care of every client to include health history review and enhanced sanitation/disinfecting procedures in compliance with CDC guidance.

Symptoms of COVID-19 include:

• Fever

• Fatigue

• Dry Cough

• Difficulty Breathing

I agree to the following:

• I understand the above symptoms and affirm that I, as well as all household members, do not currently have, nor have experienced the symptoms listed above within the last 14 days.

• I affirm that I, as well as all household members, have not been diagnosed with COVID-19 within the past 30 days.

• I affirm that I, as well as all household members, have not knowingly been exposed to anyone diagnosed with COVID-19 within the past 30 days.

• I affirm that I, as well as all household members, have not traveled outside of the country or to any city considered to be a “hot spot” for COVID-19 infections within the past 30-days.

• I understand that Take A Little Paws Photography cannot be held liable for any exposure to the COVID-19 virus caused by misinformation on this form or the health history provided by each client. Our business is following theses enhanced procedures to prevent the spread of COVID-19:

Masks will be worn by photographer  when not photographing. Hand sanitizer and/or soap will be before touching anything used in your session. Sessions will be limited to the subjects being photographed plus ONE additional adult. I understand that grandma really wants to come see her grandchild's session but at this time we need to limit the amount of individuals present during sessions. During your session long focal length lenses will be utilized to limit contact with subjects. All props will be sanitized prior to your session.

By signing below, I agree to each statement above and release Take A Little Paws Photography from any and all liability for unintentional exposure or harm due to COVID-19.

Parent/Guardian waiver for minors (Under 18 years old):

The undersigned parent & natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event & has agreed individually & on behalf of the child or ward, to the terms of the accident waver & release of liability set forth above. The undersigned parent or guardian further agrees to save & hold harmless & indemnify each & all the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act & release said parties on behalf of the minor & the parents or legal guardian.

In consideration for the photography services provided by the Photographer, the Client agrees to pay the sum of $

The Client agrees to pay the Photographer a non-refundable initial payment totalling $200 for any wedding package. This payment reserves the time of the Photographer.  The Photographer agrees not to advertise availability of this time to any other potential client.  If the Client cancels this photography shoot for any reason, the initial payment will notbe returned to the Client.The balance of the payment for any photography service must be paid in full no later than 14 days beforethe date of the wedding detailed in Section 1: 

Work Product:

The Photographer will make photo proofs available in an online gallery in a reasonable amount of time after the Client has made a final order. The client will also be provided with a USB stick containing the final digital images.

Indemnification:

4.1 - Photographer and Client agree that the Photographer is under no obligation to capture any specific moment or pose or person(s) during the shoot.  For example, the Photographer has no liability for failing to capture the bride throwing the bouquet.  Clients are encouraged to provide a suggestedphoto list to the Photographer no less than 24 hours prior to the shootto include photos that the Client would like the Photographer to shoot, but the Photographer has no liability for capturing any of the photos on the list.

4.2 - If the Photographer is unable to perform the services in this contract due to any cause outside their control, such as fire, flood, casualty, act of God or terrorism, illness, or any other reasonable cause outside the Photographer’s control or expectation, the Client agrees to indemnify Photographer for any loss damage or liability; however, the Photographer will return in full all payments made by the Client to the Photographer in relation to this shoot. 

4.3 – The Client agrees to indemnify and hold harmless Photographer for any liability, damage, or loss related to technological failure.  Cameras, hard drives, and memory cards are subject to technical failure.  The Photographer will take reasonable steps to prevent data loss, but is not liable for loss of data due to technical failure.  

4.4 – The Client understands and agrees that the Photographer is required to retain copies of a reasonable number of photos from the shoot for 6-months after the event. After this period has expired, the Photographer has no duty to retain copies or originals of files or photos from the event.  It is the responsibility of the Client to purchase, store, and backup photos after the 6-month period.  This clause is subject to the limitations in Section 4.3 of this Contract.

4.5 – The Client understands and agrees that the Photographer may have cords, light stands, and other gear at the location.  The Client will hold the Photographer harmless for any damage, personal injury, or loss caused by tripping over or otherwise being injured from this equipment. The Client further agrees to hold the Photographer harmless for any personal injury which may occur as the Client poses or works with the Photographer.

4.6 – The Client agrees and understands that the quality of a photograph is entirely subjective.  The Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the Client.

4.7 – The Client agrees and understands that the Photographer may perform digital retouching of photos, including blemish removal, creative effects, teeth whitening, and other digital image edits.  The Client agrees to hold the Photographer harmless for any edits which may be viewed as defamatory or demeaning.

Duty of Client:

The Client will obtain all permissions necessary for the Photographer to photograph at the shoot.  The Photographer has no duty to obtain the permission of reception centers, churches, buildings, properties, or other locations to operate thereon.  The Client understands and agrees that any failure to obtain these permissions resulting in fines to the Photographer, or which prevent the Photographer from photographing the event(s) is not the fault, liability, or responsibility of Photographer.

Exclusive Photographer:

The Client agrees and understands that no party other than the Photographer may take pictures of any poses, lighting situations, or setups made by the Photographer. This slows down the Photographer’s work and violates the Photographer’s right to take pictures of the event.  The Client agrees to take responsibility for insisting that no person(s) in the wedding party get in the way of the Photographer or take pictures in these situations.

Arbitration:

Any dispute arising under or in any way related to this agreement shall be submitted to binding arbitration by the Alberta Arbitration Association in accordance with the Association’s commercial rules then in effect. The arbitration shall be conducted in the province of Alberta. The arbitration shall be binding on the parties.

Assignability and Parties of Interest:

The Client agrees and understands that, unless otherwise specified in this Contract, the Client is not contracting for a personal service that will be performed by any specific Photographer.  The Photographer may sub-contract or assign this contract to any second-shooter; the Photographer may assign any Photographer associated with their Photography Company to perform the duties under this contract.  All Photographers must be capable and competent to perform the services in a workmanlike manner.

Entire Agreement:

This Agreement constitutes a single integrated Contract expressing the entire agreement of the Client and Photographer with respect to the subject matter hereof and supersedes all prior and contemporaneous oral and written agreements and discussions with respect to the subject matter hereof, and, except as specifically set forth herein, there are no other agreements, representations, promises or inducements, written or oral, express or implied, between the parties hereto with respect to the subject matter hereof.

Amendment and Waiver:

This Agreement and each provision hereof may be amended, modified, supplemented or waived only by a written document specifically identifying this Agreement and duly executed by each party hereto or the authorized representative of such party. 

Venue and Jurisdiction:

This Contract is governed by the laws of the province Alberta.  The Client and Photographer agree to subject themselves to the laws of this province except for as provided in the arbitration clause. Client and Photographer hereby waive the right to object to venue within this province.

3.      The Client agrees to indemnify and hold harmless the Photographer for any liability, damage, or loss related to technological failure, including data loss.  
4.      The Client understands and agrees that the Photographer is not required to maintain copies of the photos from this shoot 60 (sixty) days after the photos have been delivered to the Client.
5.      The Client agrees to hold the Photographer harmless for any personal injury which may occur as the Client poses or works with the Photographer.
6.      The Photographer will strive to present photos in a workmanlike manner but is not required to cater to specific aesthetic preferences of the Client. 

5. Duty of Client

1.      Preparation.The Client shall not feed the baby a full feeding for two hours before the session and shall keep the baby awake for one or more hours before the session. Baby shall be fed immediately at the beginning of the session or just prior to arrival. The baby must be dressed in loose fitting clothing for ease of changes for portraits. The Client shall bring at least two bottles for feeding or supplies for nursing. If a pacifier or soother is required, the Client shall supply those items. 
2.      Subjects.The Client shall maintain control of other subjects including siblings. It is the responsibility of the Client to ensure the cooperation of additional subjects as not to intrude on the baby’s immediate area. The Client shall provide all necessary controls over additional subjects. 
3.      Circumstances.If the Photographer is unable to perform the session due to baby’s disposition, condition, or circumstances listed within this contract, the Client shall be allowed to reschedule at Photographer’s discretion. 

6.  Exclusive Photographer

The Client agrees and understands that no other party other than the Photographer may take pictures of any poses, lighting situations, or setups made by the Photographer.  This slows down the Photographer’s work and violates the Photographer’s right to take pictures of the event.  The Client agrees to take responsibility for insisting that no person(s) get in the way of the Photographer, or take pictures in these situations.

9. Release and waiver of liability:

1.      The Photographer shall be held harmless for all injury to the Client during the photography session and the immediately surrounding events. 
2.       I indemnify, hold harmless, and promise not to sue the entities or persons mentioned in the above paragraph from all liabilities or claims made because of participation in this activity or event, whether caused by the negligence of such entities or persons or otherwise. 
3.       The Client is responsible for their own safety, the safety of those who accompany them, and the safety of each minor child that accompanies them. The Client agrees to retain custody and control of each child at all times during the session to avoid injury. Session may be stopped at any time at the discretion of Take A Little Paws Photography. On behalf of themselves and their children, the Client releases Kerry Peterson and Take A Little Paws Photography from all claims and liabilities of all kind.

3.      The Client agrees to indemnify and hold harmless the Photographer for any liability, damage, or loss related to technological failure, including data loss.

5.      The Client agrees to hold the Photographer harmless for any personal injury which may occur as the Client poses or works with the Photographer.

Clients understand they can not alter, crop, edit or add filters to images for risk of breeching copyright.

Your photographer has paid the studio rental fees at no cost to you. By signing here you agree that you will pay a $75 fee if you do not show to your allotted time slot on time, or if you do not give more than 48 hours notice of to cancel your session.
